I had come to UK in Aug-2010 in TIER 2 ICT ESTABLISHED STAFF Visa. And this visa was for one year and I got renewed within UK itself. And I believe in the month of Aug-2011 I got my TIER 2 ICT Long Term Leave To Remain visa.

Thanks

You are eligible to switch to Tier 2 General.

Check that the new employer has a T2G sponsor licence with available allocation for the current year and that he has carried out a resident labour market test for your job. The job must be level NQF6 and the salary either £20k or the min. salary listed in the codes of practice for the relevant SOC code, whichever the higher.

Don't give notice in your present job before you have actually been assigned a CoS.

Thanks a lot manci for your valuable input.

First I will check with new employer that, they do have T2G sponsor license with available allocation for the current year.

Second, they have to provide me certificate of sponsorship and the offer

After getting this I need to give notice to my present employer.

Please correct me if I am wrong.

The sequence is right but note:

when you have the job offer check that the salary/job SOC code meet the requirements (the job must be NQF6 level):
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

In the CoS the new employer has to certify that they carried out a RLMT (unless an exemption applies) which takes 28 days. Check that they have done so.

You have to agree the work start date with the new employer because it has to be stated in the CoS (together with the work end date). The work start date could be the day after you stop working for your current employer.

Once you have the CoS you can apply for leave to remain straight away. The leave to remain always starts from the work start date given in the CoS.
