Hi,

I entered in UK with WP on 28 Jan 2008 and my wife and daughter got their WP dependent visa on 18 Apr 2008 and they entered in UK on 07 May 2008. Then our visa extended for april 2011 and then I chnged my visa to Tier 1 and it is valid till 30th March 2013. Thing is that I am already eligible for PR in 28 Dec 2012 but will this new family settlement rule will affect my family or not?
if this will affect my family then in this case, they are 18 days short in thier 5 year visa as their visa is expiring on 30th March 2013 but their 5 years are completing on 18th April 2013.

Can anybody please guide me how to go for their visa. Which of the following option should I opt for:
Option 1: If they are eligible for 2 yr settlement then no issues.
Option 2: If they are not eligible for 2 yr settlement route then I will take my PR and they will have PR dependent visa for 18 days and then I will apply for their PR seperately.

They will be eligible for the pre July 2012 changes requirements. So 2 years only.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

You wife is eligible on old rules because she has been your dependent before the changes took place in July 2012 for Spouse VISA requirements.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

I have also checked on UKBA site and found following:

Following statement in this extract is encouraging and confirmed 2 yr route for my family :

If you applied to come to the UK or for permission to stay here on or before 8 July 2012 and that permission was granted, you will need to be in the UK for 2 years before you can apply for settlement.
