Spouse Visa £18,600 and student visa ??

Post by TH20051992 » Tue Aug 21, 2012 6:03 pm

Hi I just like to thank anyone that helps and that I'm really grateful.

I am a Uk citzen i was born in the Uk and last year I met my girlfriend while at University, who is from China on a visa. we are moving in together in octobber however have lived together for small peiods of time when we needed the support of each other. i am going come out and say it we both pretty shy and have had troubled pasts, I was bullied repeatedly through school and by my dad, while she suffered similer problems from her mum and was in a abusive relationsip she was forced into by a flatmate Previously.

I am saying this as the fact is that these events have led us to really rely and support each other in overcoming these problems. Through this we became closer then we could have ever throught possible. Beyond that we have the same interests and personalties as well as some same weird quirks. I can safely we are in love and have discussed on many occasions about making our own home together when we finish uni.

The reason i put this in is that just wanted to explain in case anyone throught it was a bit fast however I am planning to propose next year when i finish university in May. My girlfriend however won't finish til next year so she still has year left on her Visa so i just wanted to know if that would affect the procceding.

However more importantly is the question of the £18,600 salary requirement . The reason I am asking because at the moment it looks very likely ( unless a better offer comes up) that I be doing a internship that pays £17,500 which is grand less then what is required.

I am currently working as a part time at the local rugby and racecourse which i have been told i can keep up and take the odd jobs when availble once i start my new job. But also my girlfriend is working part time until she finished university, which brings in around £2500-£3600.

So will it be an issue that my job doesnt earn £18,600 since our combiened wage or my other job totals more?

Also can we marry while she still on her student Visa, will it be better to?

P.s I might get better offer yet but at the moment it more likely to be wage I listed above

also might propose before but have no plans on getting married til I am in full time work 0_0

At the time you apply, your combined salaries need to have been at an annual pay rate of 18.6K (or more) for the previous six months.

There is no issue getting married now. You don't have to make an application just because you get married. When does apply she will need to have extant student leave and have passed an appropriate English test.

I'm planning not to get married til I know i can support her and treat her the way she deserves to be treated, so earliest would be June once on the internship. Does getting married before or after affect the visa process would it be easier if we were married while she is on her student visa?

She can only marry while she is on her student visa; she can't switch into a partner visa before she is actually married (unless the switch was as an unmarried partner with 2 years of co-habitation, but you don't qualify for this). Or get married outside the UK and apply for entry clearance.
