Back to back family visitor visa

Post by moonraker23 » Tue Aug 21, 2012 7:00 pm

Hi,

My parents are currently in the UK starting June 2012 and have a family visitor visa until 27 Nov 2012. They are planning to return to India in Sept 2012 and not stay the full 180 days that are allowed.

Are they allowed to come back to the UK by end or middle of Oct 2012 with a new family visitor visa?

A bit confused by the 6 month notation, does it mean that since they have had a visa in 2012 once, it rules them out for another family visitor visa in 2012? and they have to wait for 2013?

Will the second application be rejected as they have stayed in UK for 100 odd days and coming back in Oct 2012 would mean they complete more that 180 days in one calendar year?

Any advise would be useful.

Generally, it's not permitted to spend (or accumulate in multiple visits) more than a total of six months out of twelve in any given 364 day cycle. As long as their new entry does not overstep this limit, they should be fine getting a new visa. To ensure compliance, they would have to say they were visiting for a period that would be for less than two months. They could perhaps visit for longer if they wished, but that would be at the discretion of the UKBA based on the reason.
