Tier1 did Case worker asked for NI Contribution Document

Tier1 Case worker asked for NI Contribution Document form my limited company.
MY PEO application on 13 Aug 2012 is put on hold asking for NI Contribution Document.
So I have provided Accountants letter (In my case I dont have to pay NI because my salary come under threshold limit) and waiting for the result.

Did anyone face the same problem and submitted accountants letter and got the approval letter.

Please let me know. Also please guide me if I need to do anything.

Did they specify what or how should the document be ?

My appointment is 31st of this month. I have got a letter from my accountant
mentioning that my total salary drawn till now is below the threshold
and there is £ X NI due, to be paid in March 2013.

Not sure this will suffice. Any comments senior members ?

should be sufficient....
But if possible get a letter from HMRC because that is the letter they asked me to produce.

As your application is on hold, maybe you need to look for information on HMRC website stating that if somebody's salary is below the threashold, they need not to pay NI and take a print out. Also, ask HMRC to write you a letter confirming the same rule and provide that letter to the CW.
Its my own thinking, and some senior member can shread some light on it...!!!

Thanks for the reply.... I have done that.
Have submitted below letter except hmrc letter as it will take more time to receive the letter and I cannot afford to wait for it as I was only given 2 weeks for sUbmission.

1) accountant letter stating the same
2) solicitor letter
3) few pages of hmrc booklet CA44
4) cover letter stating the discussion details from hmrc

Senior members please let me know if you have come across Simeone with similar situvation and got the visa.

Did you took salary from your LTD company? or you just drawn Dividends from your limited company?

If it s a Salary then you definately have to pay Class 2 NI or Class 4 depends upon your salary.

If you did not take any salary and only drawn dividends then you do not have to pay Class 2 or Class 4 NI and these things are clear on HMRC.

Hi redbull and senior members,
I was taking both salary and dividend.
And used to transfer the money combined for both from my business account to personal account.

Please suggest me in the below.
Assuming that my application will be unsuccessful and if I get to know early then here is what I am trying to do.

Plan A
Apply a fresh application in the end of sep. (my current visa is valid till 04 oct 2012)
I will be showing immediate 12 months with only net dividend.
Remember as mention before there is a single transaction for both sal and dividend, will this be ok?

Plan B
Pay my self a huge dividend for aug and sep and claim points.
By the way I will have around 5 payslips while I was working in a permanent role.
So basically the rest of the amount I will be showing in aug and sep dividend.

As you draw salary from your own company hence you have to be registerd self employed and you must have to pay class 2 NI also you have to pay PAYE(incom tax)...

This doesn't sound correct! Only a sole-trader "drawing payment" from business account has to pay Class-2 NI and register self and self-employed with HMRC.

Good News :) ....I got the love letter from UKBA. My Visa is approved.
So that mean if you are a contractor you need to pay some sort of NI if you salary is more than threshold limit.

If it is under threshold limit then produce document from HMRC or Registered accountant stating the same.

Problem solved!
