Entered UK after more than 3 months

Post by haseeb_farhan » Thu Aug 23, 2012 12:54 pm

Hi,
This is my first post here, so please be gentle. I tried to find relevant information within this site but could not find it. May be I am searching in a wrong way.
I came in UK 3 months and 10 days after getting entry clearance. My question is, whether is there any way I can avoid one more 3 month extension before applying ILR. My details are

I came here on HSMP and then moved to Tier1 after 2 years and get 3 years extension

Entry Clearance = 14 April 2008
Entered UK = 26 July 2008
Got Three years extension on = 8 Feb 2010
Visa will expire on 14 April 2013.

Any help will be much appreciated.
Thanks,

Haseebfarhan

Gentle answer is "No"

you can't bend the immigration laws or twist them for sake of your benefit !!!!!!! ( may be I am not so gentle here ) but there you go

Hi nottinghill,
Thanks for your quick reply. I am not bending or twisting immigration law according to my benefits!!!. Someone told me that caseworker may consider it if I spent less than 180 days out from country including this 3 months. I was not sure about that. Thats why I asked here.
Thanks,

That someone was wrong. The 180 days you mention are allowed absenses, and they are independent to the 3 month late entry concession given to applicants. Absenses are only counted from the date you first enter the UK.
