UK Tier2 ICT-whom compl on employer 4 not paying full sal

Post by Ram_Budda » Thu Aug 23, 2012 2:52 pm

My employer promised me for paying X amount during my employment transfer to UK and processed UK Tier2 ICT Longterm visa. And same documents have produced to UK Border agency for Visa Approval.

Visa got sanctioned and I have worked in UK for around a year, when I asked my employer about difference between committed and actual amount they said they are deducting tax as per UK norms, and they will issue me a copy of tax paying sheet end of the financial year.

But my assignment is completed and I traveled back to India recently, now they are not giving me neither tax summary report nor difference amount.

I would like to challenge my employer as per law of UK, can any body suggest me whom to complaint on this.

When your employer assigned a CoS to you what they had to state in it was your gross salary. In the UK employees normally pay tax under PAYE and this tax is deducted from the gross salary and paid over to HMRC by the employer.

However, when an employment ceases the employer is obliged to issue a P45 form which confirms the salary paid and the tax deducted during the employment. This form must be given to the employee and also sent to HMRC.

If you haven't been been given the P45 form when you finished your employment in the UK then in the first instance you should ask the employer for it. This is also important because you may be able to claim some refund on the tax that was deducted from your salary.

Thanks Manci,

Yes, but my employer not issuing P45 - and as per my knowledge they might not have paid the amount that is deducted from my package - due to that they are not issuing P45.

Can you please suggest me whom to complain about this. As I am in India right now, I am not sure whom to approach on this.

Thanks for the information in-advance.

has your job in the UK definitely finished and are you no longer in the employ of your T2 ICT sponsor?
Have you received payslips while you were working in the UK? The payslips should show your tax reference number, tax code and NI number.
