tier 4 student visa

I would like to ask you some questions regarding tier 4 general and my dependent visa. I am currently on PSW visa and my husband is on PSW dependent. We went through the UKBA home office website carefully but still we have some confusion. Our doubts are as follows:
1. Will my dependent need to go back home to apply on my dependent or he can apply from here along with me?03001234359 sheffild


2. I am going to join LSC College London, which is affiliated to University of wales international Cardiff, for post graduate degree. I did MBA from this college and want to do MSC in international hospitality management,I asked the college, they said that it is highly trusted sponsor and its Higher education institution private. So, can I work part time and what about my dependent, will he be able to work?


3. About the maintenance funds, as we are already here on PSW visa, so are we under established presence and is it alright to show the money for the living costs for up to maximum of two months. And how many months bank statement do we need to show? Or is it just a total sum of money for the living cost?

Who is issuing your Cas? LSC or the university?

CAS, do you mean the offer letter?
LSC is issuing the offer letter.but on the top of the letter head its written both the LSC and on the other side, University of wales and cardiff.any suggestion?

I mean who will be your tier 4 sponsor and issue your Cas? If its LSC then your husband will not be able to remain in the UK as your dependent because LSC is not a recognised body or a body in receipt of funding as an hei.

You will also not be able to work if you are being sponsored by Lsc.

You cannot be considered an established student if you are switching from psw-so you will need 9 months of maintenance.

what if my wife joins the university of bedfordshire,and the course MSC international tourism and hospitality management or MSC Human resource MAnagement, we both could able to work ,right?

and we are living here from last 4.5 years, doesnt it mean the establish presence?

As long as the course is more than 12 months you will be able to join her as your dependent and will have permission to work.

Established presence as a student has nothing to do with how long you have been in the UK. In order to have established presence as a student and qualify for reduced maintenance, your wife needs to meet the following requirements

Appendix C, Para 22

22. An applicant will have an established presence studying in the UK if the applicant has current entry clearance, leave to enter or leave to remain as a Tier 4 migrant or Student and at the date of application:

(i) has finished a single course that was at least six months long within the applicant's last period of entry clearance, leave to enter or leave to remain, or

(ii) is applying for continued study on a single course where the applicant has completed at least six months of that course


Your wife currently has leave as a PSW dependent and therefore falls at the first hurdle.

You will therefore need the maximum amount in maitenance (i.e. if studying in outer London/elsewhere in the UK, £7200 for your wife, and £4050 for you plus the tuition fees.

You will both also need to make the application from outside the UK as already advised.

If your wife completed her MBA on a student or tier 4 visa then the university will need to justify how she is making academic progress in studying again at the same level.

ok ,but I consulted a solicitor , they say we both cn apply from here within the UK, how long do we need to show the bank statement though?is it for 1 month, and after paying all the university fees then we have to show 7200 + 4050=11250 pound.
Any suggestion after MBA degree, not PHD, though,,,,MSC or something like that as i was saying before?
And do i have any other alternatives to extend my visa in UK except going on student visa?can you please advice me?

You have confused me as you both appear to be posting using the same username. If your wife is the psw migrant and the husband is the psw dependent, and it is the psw migrant who wants to switch back into tier 4 with the dependent remaining a dependent then yes you can both apply from within the UK.

Would suggest you speak to the prospective university about whether they consider the msc to be academic progress.
