should i apply for ILR 14 years?

Post by egoneo » Fri Aug 24, 2012 11:26 am

hi,

so i need some advice. ive been here for 14 years continuously(since sept 1998) with only two breaks in visa. once in 2003 when my school sent my application in 13 days late and in 2007 i started uni so applied before my visa ran out. they sent the whole application (but not my money) after my visa ran out also asking for a couple more letters from uni and to check a box. i sent it back a few weeks later and was granted student visa. i tried applying for ten years but they said in 2007 it constituted a break. Question is will i be able to apply for 14 years ILR even though it says a majority of peoples stay are illegl?

Bad news - there's no more 14 yr thing.

Good news - explore how you can satisfy the requirements for 10 years, if at all.

Other option - read this http://www.immigrationboards.com/viewtopic.php?t=105333

Err i am afraid you are mistaken. If you think the 14 year rule still applies to applications made after 9 July please tell us where to find it in the immigration rules.

last sentence in the link he posted

"These are the changes made by Home Office but ther's nothing abut abolishing 14yr Rule"

look at all the SET(O) application forms it mentions the ten and fourteen years quite frequently

There is no mention of the 14 year rule in the current set(o) form. There is no longer a 14 year long residence section in the rules. The post you refer to is incorrect. Click on the link at the top of the post which confirms the rule was scrapped on 9 July.

then why here http://www.ukba.homeoffice.gov.uk/visas ... tiontypes/

does it say 14 years in some cases under set(o).

They haven't updated that section of the website but they updated the rules and the form. The 14 year rule is no more. End of story.

i also meant in the guidance for SET(o) not the SET(O)

http://www.ukba.homeoffice.gov.uk/sitec ... o04091.pdf

it talks about 10 and 14 years. If they really have abolished it im pretty sure it would have been updated by now

Since you are under 25 and have spent 14 years here, which is more than half your life, you should qualify under the long residency private life route which was introduced on 9 July.
