Domestic violence and living separately ,now time for ILR !

Hi fellows,

I wonder what would happen if I apply for a ILR under the following conditions.I am now here with point-wise to make everything clear.

1. Visa status : First HSMP ,now Tier-1 extended already.
2. Visa expires : April 2013 ( 5 yrs will be completed).Need to apply for ILR.
3. Got a simple police caution under the criminal damage act 1971 ,section 1, damaged a goods of wife under £ 1000.00(as I had accepted already) in the mid of 2011.
4.It shows on CRB but allows to work for CRB related works apart from the children,disable - vulnerable people and government involved works.
5. My wife and me since then living separately,she is with my 2 kids of 12 and 8 in a refugee.I am deprived to get any information about them according to the children plan and Women's Aid.
6. Its time to think for ILR so what would happen if ,

- I apply ILR alone ?
-Apply for kids and wife ?.If they would be interested ?.More chances ,I think !
-They apply a refugee visa and I will apply my own ILR ?
7. We haven't filled up any divorce case and not in contact according to the law ( but had some contacts over telephone,and I was abusive, I know nothing reported to court yet ) apart from the social worker.
8. Still, no court involvement in this case.

Your suggestion could pave the way of lives of four .I would also be thankful to you by heart.

Actually ,I don't know who is dixon so how do you know that I am the same posting here by different name ?

As it is a matter of sharing so please try to give your honest reply here .If I were dixon and the problem has been solved ,why need to come up here again ? .Anyway I will see the thread made by dixon too.
Regarding professional help,I think everyone is aware of this ,but people want not to spend a lots of time and money in professional fees, so they do post here to see/find someone who has/ had the same problems or experience to share out .
Other people may come up with their idea ,do you agreee ?.Or nobody will come here apart from you ?.I wanna to be a bit clear about it .
Anyway , could you please provide me a simple answer to my queries ?

Hi every one,
I am an Asian ,main applicant for tier-1.I have got a written police caution in the case of domestic violence saying criminal damage of under £ 1000.00 Pounds .It normally affects for five years.

These are the common points I would like to share,

1. There was no physical violence and just verbal abuse and big threatens.
2.Burnt some clothes and shoes of Spouse,
3. It was happened in May,2011 after first extension.
4.We are living separately from then.My Spouse is living with two children of 10 and 14 years in a refuge.
5. I am covering maintenance cost of my children
6. We haven't got any divorce or lodged divorce application.
6. I am going to apply ILR next year 2013 and the month would be July.
7. She has reported to the Womens Aid that she has been abused by me since 14 years.

This is clearly recorded on record as domestic violence and children are kept separately by an agency.Its already been one year so may be no chance to go to court with that case ? . Would you advise please .
If this is not a court case and a caution stating criminal damage,I am scared with the word criminal damage .
Do you believe that it affects my ILR and citizenship ??

very similar stories don't you think. If you are not Dixon then i would suggest sending him a private message and asking him how he solved his problem seeing as your seems to be identical and you both appear to be slightly deluded in thinking that people here will want to help you.
