Change of Employment query

Post by abbyp23 » Wed Aug 29, 2012 12:43 am

Hi can anybody please.. please.. give me advice regarding my application for tier 2 general (change of employment) visa. To give you a picture of my current status, I arrived in this country January of this year under the tier 2 visa (which expires jan 2015) and have been working as a care assistant in a nursing home although my visa job type is for a registered nurse. while working, i took and completed the overseas nursing programme adaptation course and am currently awaiting my nursing registration number so i would be able to work as an RGN. Whilst waiting, I applied for a job as an RGN and have passed the interview, i was given a new COS with a start date at around first wk of september and expiry date of 2nd of november. the only date i was able to book for the premium service would be around 1st wk of october and my new employer is aware of it. i was wondering will it be a problem if I continue to work with my current employer without telling them yet that I am applying for a new visa? will the HO inquire any details of my employment from my current employer? by the way, if im applying on october yet for the visa, will it be a problem if my start date in the COS is already overdue (1st wk of sept)? and lastly would I need to have my nursing registration details with me already before applying for the new visa? I'm sorry if I have a lot of questions but im at my wits end already on how to process my application.. i have inquired from dozens of solicitors and they only increased my confusion and besides they charge an awful lot of money before even giving any proper advice. i would very much appreciate any form of advice.. Many thanks!

From the immigration perspective you don't need to tell your current employer that you are thinking of leaving them but you also need to consider the terms of your employment contract.

will the HO inquire any details of my employment from my current employer? unlikely

by the way, if im applying on october yet for the visa, will it be a problem if my start date in the COS is already overdue (1st wk of sept)? not a problem provided another work start date is agreed with the new sponsor

and lastly would I need to have my nursing registration details with me already before applying for the new visa? Try to obtain it before you attend the PEO in October but if you don't have it by then take along proof that you passed the necessary exam and any correspondence relating to the registration. Also do check that the new sponsor entered the appropriate SOC code and job description in the CoS and that your salary is at least the minimum prescribed by the rules.

I'm sorry if I have a lot of questions but im at my wits end already on how to process my application.. i have inquired from dozens of solicitors and they only increased my confusion and besides they charge an awful lot of money before even giving any proper advice. i would very much appreciate any form of advice..
