Spouse ILR Eligibility

Dear All,

I am an Tier(1) General Migrant, Going to Apply for ILR on October. My Wife has short of 32 days(1 month and 2 days) for 2 Years ILR Eligibility.. When Enquired at UKBA they said my wife need to Apply for FLR(M).

But one Solicitor Advised me that "If we apply Through Post now The application processing time take more than 3 months so that 1 month short automatically covered during that processing period and Wife's ILR application will be succeed..".

Any Idea for this case..?
Any one get ILR like these..?
