URGENT: Tier 2 ICT Established Staff - Dependant Visa

Post by jfree » Thu Aug 30, 2012 11:26 pm

Greetings to everyone,

I have followed plenty of posts on this forum before, however because this is the first time I officially post here, thousand apologies if I sound terribly confusing. Your understanding is much appreciated! :)

I came to the UK as an ICT work permit holder in October 2008, and when it expired in Oct 2010 my company (an A-rated sponsor) applied for a 3 year extension which at that time put me under PBS Tier 2 ICT Established Staff category.

At the moment, my situation is this:
Me and my love one were married in June 2009 back in our country (Malaysia), and now (I know it could be a bit late in applying dependant visa, having been married for 3 years already) I would like to apply a dependant visa for her to come over to the UK, although my visa will be expired in another 14 months (October 2013). Please can I after some advice on whether or not this dependant application is still a strong case to go ahead albeit the fact that I have only 14 months left in my visa?

Another thing that has been bothering us for a while is the supporting evidences that we need to submit. We have read through the UKBA website and the related guidance notes (VAF10, http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf) multiple times, it seems to us that only the following supporting evidences/documents need to be submitted. Please can any kind souls have a look to see if our assumption is correct:

From the dependant:
1. Current Passport (Can anyone advise on whether or not previous/old passport is a must? My wife has searched through the house but can't find it so far, which worries us a lot. Will her application be refused if she fail to submit her previous passport?)
2. Most recent passport size photo (not older than 6 months)
3. Her Birth certificate
4. Our Wedding certificate
5. Bank statement showing 3 months transaction
6. Bank passbook
7. Letter from bank confirming that the fund has been held in the account for 3 months
8. English Language Requirement
9. Relationship evidence (Wedding photo, travel photo, phone bill showing the phone calls between us, email log, Skype conversation log, MSN & Facebook chat log)
10. Travel confirmation email/boarding pass (showing my wife has been visiting me in the UK regularly, in order to maintain our relationship)

From the Tier 2 ICT visa holder (myself):
1. Notarised Passport Bio Page (Is it good enough if I go to Post Office UK to notarise this?)
2. Notarised UK Resident Permit - Copy
3. My Birth Certificate
4. My UK Bank statement showing 3 months transaction
5. Letter from my UK bank confirming that the fund has been held in the account for 3 months
6. Letter from A-rated sponsor, confirming that should it become necessary they will support my wife for at least a month
7. Three months Payslip (To confirm my employment with the sponsor?)
8. Employment Letter (To confirm my employment with the sponsor?)
9. Home Office Letter confirming my permission to stay and work in the UK
10. Utility Bills such as water bill and TV Licensing bill (To confirm I have a place to stay in the UK, and if my wife is allowed to join me in the UK she will have a place to stay?)

Please pardon me if I sound confusing here. Your advices will help us greatly in this tricky and intimidating journey. Many thanks in advance!

Best regards,
Jfree

There is no problem in applying for Tier 2 ICT Dependant application, however your wife visa will be stamped till October 2013 same as your visa.

Regarding documents you can also add original Tenancy(Rental) agreement & NOC from landlord. ( For over-crowding policy)

Hi Kumar,

Thanks for you prompt response. The Tenancy(Rental) agreement for the flat that I am currently staying is between my employer (company) and the landlord, which means it doesn't have my name on it. Do you think it is still valid to submit that? Thanks again.

Can anyone also shed light on whether or not submitting your previous passport is a must?! As mentioned above, my wife can't seem to find her previous passport now! :'(

Yes you can submit the tenancy aggreement btw your sponsor and landlord, also include a letter from sponsor about your accomodation details like address & desciption of the property.

Regarding previous passport, VFS office in bangalore(india) had asked for previous passport also (out of country application), but check with others on this forum ........

Thanks for your help Kumar, you are very helpful!

It is a bad news for us if previous passport is a must. However, I assume not everyone keep their previous passport when it expires, right?

In the online application form, UKBA ask if we have previous passport, and if we have, where is it now. In our case, can I choose 'LOST' instead of 'EXPIRED' instead? Would it be better for our application?

It would be great if anyone can shed more light on whether or not previous passport is a must. Thank you all, thank you!
