Unfortunately, I don't have a solution for you. You need to keep at them until you get satisfaction. You need to keep complaining, keep pestering them.lalolaal wrote:Yah its me again and i am so frustrated now because my application is still under process and 19 weeks have been passed. In mean time i have contacted British high commission Islamabad dozen times. In return i always got a generic reply that my application is under process and we are sorry for inconvenience and also that all application will be processed within 24 weeks.. I have written every time that a EEA Family permit issued under EEA regulation free of charge and as soon as possible..Now i want to tell you something my solicitor says that if they process your application within 6 months it should be considered as soon as possible..To hell with these peoples.I have also contact the eu commission but got nothing from them..I have also send mails to UkBA immigration inspector and to the consular in islamabad..But i got same generic reply blah blah blah...Its seem so appaling.
Could anyone tell me more specific interpretation of as soon as possible and what should i do now so they can start processing my application because they are treating my app as settlement visa and now a days they are processing march applications of settlement category and i submitted in april so i have to wait another month or any other thing that i should do.
Member States shall grant such persons every facility to obtain the necessary visas. Such visas shall be issued free of charge as soon as possible and on the basis of an accelerated procedure.
Thanks for your reply.I have found this on some website I don't know what is this.A directive or regulation.EUsmileWEallsmile wrote:Unfortunately, I don't have a solution for you. The solicitor should note the following ref article 5 of directive 2004/38/EC
Member States shall grant such persons every facility to obtain the necessary visas. Such visas shall be issued free of charge as soon as possible and on the basis of an accelerated procedure.
I appreciate what you are suggesting, but an EEA family permit should not take six months - especially when the same issuing station can issue same day (or nearly) visas.keffers wrote:Is your application taking considerably longer than others at the same post?
You cannot compare times with other countries as various factors come into consideration ie volume of applications; the corrupt nature of a country neccesitating a more in-depth assessment; staffing levels ; inadequate training etc etc etc.
I would wait the extra 5 weeks before launching into unbridled complaints mode as I don't see it achieving anything except personal irritation.
What you are looking at is the EU commission's guidance to member states regarding the directive 2004/38/EC.lalolaal wrote:Thanks for your reply.I have found this on some website I don't know what is this.A directive or regulation.EUsmileWEallsmile wrote:Unfortunately, I don't have a solution for you. Third country family members should be issued as soon as possible and on the basis of an accelerated procedure with a free of charge short-term entry visa. By analogy with Article 23 of the Visa Code[19] the Commission considers that delays of more than four weeks are not reasonable.
