Help for FLR (M) with unspent conviction

Dear All
Please can you share your thoughts if you have come across a similar situation as mine.
I would be applying for FLR (M) as a spouse of my settled wife, after mid of October. My wife will be apply for her ILR in the first week of October at the PEO and she meets all requirements of ILR.

I have got an unspent conviction (DR10) which will become spent in May 2014, and I wanted to know if my application will be held up by the Home Office for further checks, even if I apply at the PEO. I have read various posts of other members complaining about the delays in processing applications which can take anywhere from 4 months to 6 months or even longer, and I am really concerned as I have overseas travel lined up for business and holiday in the next few months.

I would be meeting all other requirements as specified by the Home Office. Also do I need to submit my Wife's Passport or BRP Card with my FLR application, because she may not receive her BRP card in time for my application which is after 15 days of her appointment. Or can I just give the Home Office Reference Number from the letter which she will get after her application is successful.

Please let me know your thoughts.

The PEO staff may not be able to make a decision on this and will refer it to a more senior grade....which will mean paying the premium fee for a referred postal application.

Casa Thanks for your reply, I understand what you have said, but are there any other documents that i could submit alongwith my application for them to make a decision same day, because it is very important for me to get my passport back ASAP. My job involves international travel and I could even get a letter from my employer stating this.

Will submitting a latest ACRO certificate showing any unspent convictions will help the Case Officer to make the decision same day?

Can some one also answer the other questions in my previous post.

Would appreciate if any other members can share their thoughts.

FLR M Success at Croydon 10/10/12 with unspent conviction

Dear all
Just wanted to update on my application.

I had my appointment at Croydon today for FLR (M) Application at 8:50 AM. I had an unspent conviction of DR-10, so had to go for FLR instead of ILR along with my wife who qualified on 5 years Work Permit.

The documents that were asked are as follows:

6 months Bank Statements
6 months Pay Slips
English Certificate from Trinity College
Wife's 3 months Bank Statements
Wife's 3 months Pay Slips
Wife's Passport and BRP Card which we received on 9th Oct after her application for ILR ON 5th Oct 12 at Croydon
Marriage Certificate
8 Items of correspondence for the past 2 years addressed to me and my wife. We had 5 in Joint names and the rest 3 were in our individual names. They were spread across 3 - 4 months

These were the documents asked by the CW and the whole process took 3 hours due to the technical glitch in Biometrics today morning. I just had my and wife's P60 and ACRO Certificate as additional documents but were not asked by the CW.

Overall it was a very smooth process and the application got approved without any difficulties, I would advise others that just take the documents that are asked and are relevant.

Re unspent criminal conviction: this was my personal call but I would say, if you think your application is straight forward and if you meet all the requirements, then do not hesitate to go for a premium appointment if your circumstances demand.

Now waiting for BRP and then a holiday to Italy.
