We had appointment for FLR(M) case, dependant of ILR.
We reached there, got a token and then saw case worker. The first thing he said you have got a wrong filled form. This is not the right form for a person who needs to extend his/her stay to complete 2 years to qualify for ILR.
According to case worker, there is a supreme court decision which supper seeds all UKBA decisions. He said we can not accept FLR(M) as that requires English language requirement and Supreme court has given decision against this. He said you will have to fill FLR(O) and show all the same docs when your spouse got visa as Tier-1 dependant. So he asked marriage certificate, and financial proofs as well. Luckily I had marriage certificate, and all the financial docs as recently I got ILR so I had the same set with me. I argued with case worker and he called other senior case workers and all of them were agreed on a single point that you have to apply on FLR(O). Strange thing is I have discussed with a case worker two days ago in Croydon and she confirmed that I will have to apply on FLR(M) for my spouse.
We filled FLR(O) and got the extension. It took almost 3-4 hours as argue and then fill FLR(O) form but the good thing is net result was acceptable
