Availing HMRC tax benefits make ineligible 4 Visa extension?

Post by ashishsgoel » Sun Sep 02, 2012 6:31 pm

Hi Everyone,

I came over to UK in January 2010 on ICT tier 2 visa which expires in January 2013.

After getting in UK, I have been benefited with tax relaxation on living allowance under hmrc rule “EIM77010” http://www.hmrc.gov.uk/manuals/eimanual/EIM77010.htm in my salary for initial 2 years of my stay here.

Now when I need to apply visa extension, I have been advised that visa can not get extended because I have had living allowance benefit.

This sound wrong to me. Could anyone advise on this please ?

Thanks

Whoever "advised" you mixed up claiming public funds with obtaining tax relief under EIM77010. The two have nothing to do with each other and the tax relief you got will be no impediment to obtaining an extension.

Hi Ashish;

Can you tell me please what happened finally to your visa extension?

I'm having similar concern for mine.
