maternity leave outside UK after baby born in UK

Hi Team,

My wife has arrived 16th June in UK (2 years rule for ILR); She is pregnant, expecting baby mid of December 2012 and planning to go India after 2 months of her delivery and will be back with in 4 months, will it be considered on her maternity leave (6 months) when applying for ILR.

This period of absence will not matter or be considered a problem for her ILR eligibility.

i conclude that..with in 6 months for maternity either uk or outside uk irrespective of baby born in uk or outside uk is fine.. :)

If you are asking is it OK for your wife to spend all her maternity leave outside the UK....then I Would say that would be fine.

If on the other hand you are asking if it will have any effect on her ILR application when her 2 yrs probationary period is up .....then I would say yes it will have an effect because to spend 6 months out of 24 in this period is excessive for ILR and she may have to apply for FLR to make as much as the 24 months period that she is required to spend before applying for ILR.Going abroad to give birth and then stay there for up to 6 months is not a valid reason to spend that much time out of UK
