Hi Team,

My wife has arrived 16th June in UK (2 years rule for ILR); she is pregnant, expecting baby mid of December 2012 and planning to go India for delivery. When she was in maternity holiday, her visa will be expired on 12th Feb 2013. I need to process new visa or have to process visa before 12th Feb 2013 in India. I heard that if I process visa in India irrespective of expired or current. That will be considering as new visa and new visa rule.

Could you please clarify this scenario? I am eligible for ILR Feb 2015.

If your visa status changes, and her's expires(while she is in India), then it would be treated as a new application for you, and the current rules(at the time of application) apply.
