change of jobs on tier 2

Post by ts1 » Thu Sep 06, 2012 9:24 pm

Hi all

Was wondering if any of you could shed some light on my query.

I am currently on Tier 2 (General) and have been working in the UK for the last 4 years (started 1st of September 2008).

I have just been informed by employer that they are looking to downsize as their cost base is too high - and the first area they want to stream line is their payroll costs, which obviously means that my job could potentially not be required.

Nothing is certain at the moment, but I am just wondering if any of you could tell me what my options might be? If I apply for other jobs, will the visa transfer be straight forward - especially considering that I should be eligible to apply for my ILR next year?

Also with the constant changes in immigration rules and employers being discouraged to take on non-EU workers, do you think finding another job is somewhat possible?

Any guidance/information you guys could provide would be much appreciated. My main concern is just the ILR - don't want to lose out on the sacrifices I've made over the last 4 years!

Thanks a lot in advance :)

You will need a CoS from another sponsor but otherwise switching is straightforward.

Also with the constant changes in immigration rules and employers being discouraged to take on non-EU workers, do you think finding another job is somewhat possible? It is possible, but it is a market place (supply/demand)

thanks for the prompt reply manci.

just a couple of other questions anyone could help me out with...

as I am in the consultation process at the moment, I am trying to look for other vacancies within the firm - some of which are not in my field of work. I'm just applying for internal vacancies because i thought it would be easier getting a job internally. However if I was to get one of the internal vacancies, that could potentially mean a different role altogether and a salary that is lower than the £35,000 threshold.

My question is, if I am able to secure a job internally, do I have to earn at least £35,000 for the full 12 months when the time comes for my ILR application? Also taking up a different role within my firm - could thislead to issues with my ILR application?

At the same time I also applying for jobs externally, so I can continue to work in the field that I am, but as I have found out - employers are reluctant to give out work permits. It's a tough time, but I'm hoping I can get through it!

Any help will be much appreciated :)

The £35k pay threshold will only apply from 6 April 2016:
