Tier 1 Extension 5 year ILR and 10 year ILR both in jeopardy

Hi,

i came in 23/01/2004--visa expires 17/01/2014 (5 days short of 10 years)

Im in double jeopardy...after my tier 1 general visa.... i was jobless for first year and half).after that im working.
i was out side UK at a stretch for 92 days. (but im not outside of uk more than 140 days in 5 years of tier 1(3+2))

and at the same time if i want to apply for 10 years long residence am 5 days short (came on jan23/04 and my tier 1- 5 years expires jan 17/2014)

My status was 2 yrs Student+ 1 yr SEGs +2 yrs Student+5 years tier 1 general

I dont know which one i have to apply for??

both seems problamatic..any help plz..
