Post Study Dependent switching to UK Tier 1 (Entrepreneur)

Post by ns123 » Sat Sep 08, 2012 8:46 pm

Hi -

This is the first time I am posting on this forum so apologies if this is an issue that has been brought up before. I just wanted to ask if it's possible for someone that is a Post Study Work visa dependent to switch to the UK Tier 1 Entrepreneur visa? And if it's a yes, is the limit of £ 50,000 applicable?

On the guidance it says Post Study Migrant but I am not sure if that covers the dependent as well?

Thank you in advance for your response.

No, you can't switch inside the UK, and the 50K capital sum is only with regard to PSW migrants (which you are not) who apply from inside the UK.

Thank you very much for the response.

So just to clarify, as a dependent of a Post Study Migrant switching to the Tier 1 Entrepreneurs visa requires leaving the UK and making the application from outside the UK?

Thanks again!

Hi Shaukat -

Thanks for your response, if you could share the ref. documents that would be very helpful!

So you think switching from the dependent visa (of a Post Study Migrant) to an Entrepreneur Tier 1 is possible with the amount of £50,000?

Thanks very much.

http://www.ukba.homeoffice.gov.uk/polic ... es/part6a/

see para 245DD(e)

A psw dependent does not have leave in any of the categories listed and therefore cannot apply for leave to remain (ie switch) and thus has to apply for entry clearance from outside the UK.

That, also, is not possible. There is no PBS dependant switching into the T1 (Ent) category permitted, irrespective of the capital sum.
