ILR return to the UK after 5 years

Post by gopinath75 » Sun Sep 09, 2012 6:22 pm

I got ILR 6 years before I haven't applied for British Nationality . Since from 5 years I have been living in India. I have never been to the U.K in the last 5 years . My husband and my son are British Citizens , who are also living with me in India. Now we want to relocate to the U.K, as an ILR holder can I relocate to the U.K with my husband and son?. My friend wants to know this .

After five years of uninterrupted absence, it's highly unlikely that you qualify as a returning resident. However, have you actually been to the UK recently and, if so, what happened when you entered?

If you have not been to the UK for at least two years, you will need to apply for a new settlement visa, and if granted, you will become re-eligible for ILR after five years of residence in the UK.
