dependent visa status while main applicants is under process

Post by dhans » Mon Sep 10, 2012 10:35 pm

Hi All,

Mine and my two dependents (they don't qualify for ILR) visa expires on 20th Nov, Planning to apply for ILR for myself at PEO, then FLR(M) for dependents at a later date at PEO.

In case, decision on my application is not made before 20th Nov, can my dependents stay legally in UK?

I have prepared all the documents for Tier 1 extension as well in case something goes wrong.

What you guys suggest, should i go for ILR - FLR(M) or tier 1 extension

with regards
Sekar

It would help if you mentioned who your two dependents are, when they entered, when you entered, , etc. etc....
Please do not send me PM if I haven't sent you one yet.

My dependents are my wife and son (1 year old, born in India). Total duration of thier stay in UK is less than two years. I entered UK on 16th Dec 2007 (within 28 days upon getting EC under HSMP)
My wife entered UK in June 2010 and left to India on March 2011 (10 months) again joined me in May 2012 along with baby (5 months - till this month).

Many thanks for the replies.

I called the HO customer care, was advised to apply for FLR(M) via post before my dependents visa expires and to mention that "Pls consider this application once main applicants case is decided ..." in the covering letter

I know, It is going to be long wait, atleast there is a backup plan

she has completed more than 2 years with u i.e june 2010 - june 2012. why are you applying for FLR (m) i dont understand. dependents don't have any absence allowance. they are free to come and go any time.
