Spouse Visa /CP (KOL Req)

Hi,

Spouse has recently been issued a Spouse Visa with the endorsement KOL req expiring December 2014 ( we have been living together with spouse overseas for more than 4 years).

However, since the immigration rules changed 9th July can someone please advise on the following:

1. Can we immediately apply for ILR after sitting for and passing the Life in UK Test.

2. How long do we need to stay for after the ILR is granted before applying for citizenship.

Any reference links will be appreciated.

1) Yes, I would suggest you do this asap as there is another date coming in 2013 that would require an English Language knowledge alongside LIUK test for ILR applications.


2) As soon as you have an ILR, you can apply for BC after an year.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

2. No, (subject to your partner being British and not an unmarried partnership) you require 3 years of residence and to have ILR.

Yes, assuming she gets ILR, she may apply for BC on the third anniversary of the date of her arrival in the UK.
