ILR-What cattegory??

Post by buffy_is_not_fat » Tue Sep 11, 2012 7:56 pm

Hi everyone, I am brand new to this so please excuse any silly questions!

My boyfriend came to the UK 7 years ago and has a limited leave to remain visa. He came with his family, though it was his step-dad who obtained the entry through having a British parent.

My boyfriend is now 21 so will he be able to apply on his own or does he need to do it with his family? We have been together three years, but do not have any joint statements so I doubt he can go for spousal visa?

If anybody has any idea what category he would fall under, or even where to start this would be a great help!!!

You do not need to show joint bank statements or even any accounts on joint names. It is good if you have one but it is not required.

You can use all other evidence going to the same address for both of you even having your accounts seperate. As evidence you would need far more evidence then you might be thinking such as emails, phone bills to show communication, letters to the same address to show you are living together etc.

In terms of which category and how you should go about applying for a VISA, I leave this to other experienced members on the board.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

In what category did he come here under? When does his leave expire? Does he live with you or his parents? What is their current immigration status? Is your boyfriend currently working?

At the moment he has limited leave to remain until 12th November 2013. His parents also have this, however they are returning home in the next couple of months (for good). We both live with my parents so have no official rent to pay, and he has been working since June/July (after 5 months unemployment) and is self-employed, which I think makes the process even more complicated!!!

Unfortuantly, his parents aren't really giving me much information- not sure if this is because they would rather he didn't stay here, or if they genuinely don't have much understanding...I very much doubt they have kept all their paperwork in a safe place!

Does anybody think it is worthwhile contacting an immigration lawyer? I've heard the fee's are about £200 and wouldn't mind doing that if it saves all the hassle!
