Is Cooling period applicable in case not travelled at all?

Is Cooling period applicable in case not travelled at all?

Hi,

I had been granted Visa(Tier 2 ICT Short Term staff migrant) for UK which was valid from 6th July 2011 till 3rd June 2012. After I got my Visa the scheduled assignment was cancelled and hence I did not travel to UK. Now there is another urgent requirement/assignment in UK for which I need to travel. Does the cooling period of 12 months apply to me in case I apply for a the same Visa again? Thanks in advance for your help.

You can't be granted a new visa unless it will be long-term, and you made no mention that it would be.
245GB. Requirements for entry clearance

To qualify for entry clearance as a Tier 2 (Intra-Company Transfer) Migrant, an applicant must meet the requirements listed below.
[...]
(d) The applicant must not have had entry clearance or leave to remain as a Tier 2 Migrant at any time during the 12 months immediately before the date of the application, regardless of whether he was in the UK during that time, unless paragraph (e) below applies.

(e) Paragraph (d) above does not apply to an applicant who is applying under the Long Term Staff sub-category and who has, or last had entry clearance or leave to remain as a Tier 2 (Intra-Company Transfer)
