I am a British national who has recently married a Bangladeshi, he came here in 1997 on a student visa and at that time was able to work while studying so has a temporary NINO. He has an ongoing case with higher tier tribunal about right to stay, and awaiting a court date. He is subject to immigration control.
After marrying in July we claimed for joint tax credits, so far they have asked for more information ie my passport, his passport(which is with the HO) his documents for entry into the country, and my children (from previous marriage) birth certificates. We have supplied all of this but every time we ring we just get told no decision has been made.
Do we need to involve our MP and because he previously had a temporary NINO (which they say they dont recognise) will we need to go through an interview to confirm his identity?

Hi, did you resolve your case yet? They have asked us to send all these documents also. I will send them on Monday hopefully

Arrived at Visa section 27 May
With courier attempting delivery 13 August
Visa stamped (granted) 12 August

Yes eventually was resolved a few weeks ago after about a 12
Week wait but they did back pay from when claim
Was made.

So i guess they eventually excepted the temporary nino he had from when he was a student?
What is his status is he an overstayer?

No they didn't accept his temporary one, they
Applied to the tax office for a new one which took about 4-6 weeks.
He overstayed due to a severe illness which he was hospitalised for, for some time, he applied for an extension to his visa as soon as he was well, but then was refused because seen as an overstayer. He has been fighting this ever since and in march this year was granted to stay by the court. Unfortunately the HO has appealed this decision and we are now waiting for it to go to Hogh Tier tribunal. Very distressing for both of us and our two little girls who cry every time I say he may need to go back to Bangladesh :( I just hope we get a positive outcome soon so we can get on with our lives as a family.

I hope everything goes ok for you? it must be very stressful i thought it was always immigrations policy never to split familes up.

Where did that so-called "temporary NINO" come from?

Why did he not apply for a proper NINO when he came here in 1997?

I too am curious about this i thought when the goverment issues you with a national insurance number its yours for life and obviously they use it as a form of identification, so when he was issued with the national insurance number in 1997 this would be a way of identifying him i dont know whether this is right or wrong just pure speculation on my part.

Do they issue such things as temporary disposable ones?

Two points. Firstly, ordinarily, the Government only issues one NI number for life (but see below). But there used to be a procedure whereby an employer could effectively invent a temporary NI, starting with TN. Employers no longer have that ability.

Secondly, a NI number is allocated for life, except someone who has been declared bankrupt will be allocated a new one. This new procedure only started in the last couple of years.
