some questions re Surinder Singh route

Post by yaz » Sat Sep 15, 2012 6:43 pm

Hello :)

Please can somebody advise me on the following:
1) Can my mother (non-EEA nationa) who is currently in the UK and has a "C" (family visitor) visa, apply for a visa to travel to Ireland with me (or on her own, to join me in Ireland) while still here? From some posts it is suggested that it is possible, but, according to the Irish Embassy website, the UK visa holders can only apply for Irish visa from the country of their own residence: http://www.embassyofireland.co.uk/home/ ... x?id=49653 Please can you advise?
2) Please can you also advise whether it matters on what type of visa my mother travels to Ireland in the view that after I start exercising my treaty rights as a worker in Ireland, she will need to apply for the Irish residence card. Won't the fact that she enters Ireland on, for example, visitor/tourist visa cause problems when she applies for her residence card later on? (Please see: - http://www.embassyofireland.co.uk/home/ ... x?id=33732 'A visa holder who remains in Ireland longer than the permitted period and/or who submits false or misleading information in support of his/her application may become liable for prosecution and/or subject to deportation.') I also understand that, if having an ordinary (tourist?) visa, she won't be able to stay in Ireland for more than 3 months but she'll need to stay there with me for at least 6 months in order for us both then return to the UK?
3) Please can you also let me know - in some other threads there are mentionings of "EUTR", 'family permit' and 'free movement visa' - do they all refer to the same visa type?
Many thanks in advance
