Do I Qualify for British Citizenship?

Post by NavyBlue » Sun Sep 16, 2012 2:56 am

Hello everyone, I am wondering whether I am eligible for British Citizenship, the details are as follows:

Myself
-Born in Australia- Australian citizen
-Have never lived in the UK

Mother
-Born in Malta while my grandfather was serving for the British Navy
-Returned to the UK shortly after her birth
-Emigrated to Australia with my grandparents when she was 12

On my research so far it seems fairly straightforward that I would be eligible, using the following checklist (14):

http://ukinnewzealand.fco.gov.uk/resour ... ruitedinUK

HOWEVER, there are two issues:

1) Checklist 14 asks for my mother's UK passport, however since she emigrated as a child she was able to do so with her name listed under "Children / Enfants" in the description section of my grandfather's passport. Is this acceptable or will I need to apply for a UK passport for my mother first?

2) Checklist 14 also requests a "Letter from the Defence records office or relevant government department confirming that the applicant’s grandfather was recruited in the United Kingdom and was still in crown service at the time of the applicant’s mother’s birth."

I have a Certified Copy of an Entry of Birth occuring outside of the United Kingdom, with the rank of my grandfather (and ship) with it signed by the Registering Officer for Naval Welfare Office and Naval Registrar. There is no mention of where he was recruited however under the "name and residence in the UK" he has "*his name* and England". Is this sufficient?

Thanks in advance to anyone who is able to offer guidance.

Best would be to contact the consulate to see what would satisfy their requirements.
