Applying on Tier 1 route,do I need any WP related documents?

Post by yuleyule » Mon Sep 17, 2012 7:38 pm

Dear All,

My qualification period for ILR is based on approximately 2 years of Workpermit PLUS approximately 3+ years of Tier 1. I will be applying based on Tier 1 route.
My background:
• After being a student, got my work permit in August 2007
• Got Tier 1 (general) visa in July 2009
• Extended Tier 1 (general) in May 2012

While applying, do I need to show anything (payslips, letter from employer etc...) from my WP period or I just have to show the last 12 months payslips + bank statements (similar to the one I showed during my Tier 1 extension)?

Look forward to hear your advice. Thanks a lot in advance.

Kind regards,
Vasu

The WP letter/certificate comes to mind.
Please do not send me PM if I haven't sent you one yet.

Thanks wpilr_nov12 for your reply.

I'm not sure if I ever received any WP certificate or letter. I was under the impression that as I would be applying under the Tier 1 route, I was supposed to be providing same documents when I had provided for my Tier 1 extension. Can you please provide me any guidance on this?

Kind regards,
Vasu

Thanks sushdmehta

I did look into the Set (O) application and guidelines. The way I see it is: I'm not supposed to give any WP related documents, but only the same documents I had provided for my Tier 1 extension. However, I could be wrong, so would like to take a second opinion. Please let me know if I'm missing anything here.

Kind regards,
Vasu

Thanks sushdmehta,

If I'm not wrong, 11G is for HSMP category. Based on my background, I think I should be under 11L. Please let me know.

Well spotted! My mistake.

But, the last point / sentence under both is the same or have the same meaning.

Cool. Thanks sushdmehta

11L on page 43 says "........documents showing that you met the relevant requirements of immigration rules".

Can you please let me know what this documents can be? Looks like, I have a lot of digging to do, depending on what exactly is required.... Isn't my first/extension of Tier 1 sufficient as they were based on my first WP?

Kind regards,
Vasu

@ Vasu

My case is similar to yours and i am applying for ILR in 3 weeks time.

I would think that we would need to show the original Home office letter that we got at the time the work permit was issued. Along with that work permit letter, we could also show the P45 from work permit sponsor employer or the payslips for the whole duration with work permit sponsor employer.

I can't think of any other docs for this. But yes as you said earlier, last statement of 11L does seem to suggest that we would need to supply some documentation for the work permit duration.

Having read through numerous posts discussing the issue is, it appears that most caseworkers are not too bothered about these documents ... but some do want to see them.

So, the best thing is to be prepared. As mentioned, WP approval letter or P60 or payslips covering the period in question should suffice.
