Discretionary leave and ILR

Can anyone help on this scenario?

Appeal against refusal of ILR (long residency) allowed on 15.10.04

Allowed on HR grounds (article 8 )

'Limited Leave to Remain' issued/stamped in passport 17.10.06 - 13.10.09.
Home Office letter stated leave was granted on a discretionary basis outside immigration rules.

Further application made on 08.10.09

'Limited Leave to Remain' issued stamped in passport 12.05.10-13.10.12
Home Office letter stated leave was granted on a discretionary basis outside the immigration rules.

Considering the total period from 17.10.06 to 13.10.12 is just under 6 years, would ILR on SET (o) be the right application to now make?
