Child Born in the UK .. Parents on ILR

Post by valluvan » Tue Sep 18, 2012 12:28 pm

One of my friends has recently got a baby. They are on eligibly for British Citizenship, but currently on remain ILR. In this case is the baby already a British Citizen by Birth?. Can the parents apply for a british passport based on this? They want to be going abroad in a couple of months and hence the question..... Thanks ....

The child, having been born to ILR Parents, is entitled to be registered as British Citizen under section 1(3). They only need to submit the child's uk birth certificate and the evidence of parent's ILR. Once the baby is registered, then they may apply for his or her first British passport.

When both or one of the parent had ILR at the time of childs birth, you can apply directly for Passport. There is no need to apply for registration of your child as british citizen.
