Defacto Question

Post by Dazed » Tue Sep 18, 2012 5:28 pm

Hi,

Was hoping someone could clarify with me if me and my girlfriend have to be living together.

WE have been together almost three years and have lots of proof in the form of photos, emails, phone call records

As well as wedding invitations and holiday records.

Is it a necessity to live together ?

Thanks
Keith

Hi Keith,

Yes u have to prove that u were living together in the form of a couple. you need to provide Evidence of relationship of at least 2 years duration if you are Irish citizen and if you are an EU citizen than proof of 5 years (i.e. tenancy agreement, utility bills, bank statements, etc)

you could find more details here:

Thanks for coming back to me,

While I read the webste before and it said

Non EEA nationals who wish to remain the State and are in a de facto relationship with an Irish National must be in a position to provide evidence of a durable attested relationship of at least 2 years. The following documents must be provided to General Immigration, INIS, 13-14 Burgh Quay, Dublin 2
Copies of current passports of both parties.
Evidence of finances of both parties
Evidence of relationship of at least 2 years duration (i.e. tenancy agreement, utility bills, bank statements, etc)

Subject to the immigration status of the non EEA national permission to remain may granted. This permission will exempt the non EEA National form work permit condition.
The above is not an exhaustive list, and you may be asked for additional documentation in support of your application

It doesnt specifically state you need to be living together just you need proof of a relationship for two years. I understand it is harder to prove that without (i.e. tenancy agreement, utility bills) but surely still possible

Is it a necessity to live together? It would certainly be easier.

What makes you think that your relationship is one akin to marriage? (You don't need to answer that here, but that's what the recipient of the application will be looking for)? Do you have children? Do you have joint finances?

I see you have reviewed the website yourself, which is good.
