Will I be Qualified for ILR?

Hi,

I got my HSMP Visa on 23rd July 2008 but due to some unfortunate circumstances I could not travel and entered on 15th Jan 2009. I am now on my 2nd extension and my visa expires on 23rd July 2013. Since I entered late , do i have to apply for another extension to cover the missing period or am I eligible to apply for ILR?

My Son expired and for that reason (Unfortunate Ciscumstances) i could not travel. I also have the evidence

2nd extension in 2013 and then ILR in 2014.

Thanks foryour help. If I apply for the extension, do I have to take into account new rules to calculate my points or old rules
