Tier 1 Dependent Rejected - Appeal : 2012

Hi,

I got married on July 25th 2012.

My wife applied for Tier 1 dependent visa on 3rd September 2012 and it was rejected on 14th sept 2012

for the following reasons under 319c

- HSBC statement dated up to 01/08/2012 is more than a month prior to your application which was submitted on 03/09/2012.

- Citibank ( my wife's bank statement in india) shows minimum balance of 10,000 which is less than minimum funds required.

My question to all is

1. Is it a requirement to have some bank balance in india in my wife's name.
2. Can my wife appeal in india or does she need to send the appeal to UK i.e Is it possible for her to go back to Chennai consulate and submit the remaining documents.

1. HSBC statement is out of date.
2. Indian statement does not show enough maintenance funds.
Hence refused.

Whether appealing is of any use cannot be suggested based on the little information given about the case. In my opinion and based on information shared - no.

Appeals can now only be made in the UK.

Thanks for the reply.

Even if i decide to apply again , do i need to show some funds in india for my wife? , no where in the guidance it says wife should have funds in india.

Not necessary.

You can show funds either in India or in UK's bank account or combined... either the account is in your name or in your wife's name or joint.

I guess since my bank statement was not valid they considered her statement.

Will it help if i appeal along with the latest bank statement?

Ok so if decide to apply again; should i attach my wife's bank statements?

My latest bank balance is more than enough for the maintenance fund requirement.

My only concern is whether i have to show 1 set of maintainence fund in UK and another set of maintainence in india.

No harm in showing both. If you think only UK a/c is enough, then you can send that only.

Do not confuse case worker and keep it bare minimum.

Requirement is to show maintenance fund statement, not older than 30 day in either your or dependent or joint name from any country in world.

So you can show your less than a month old statement from UK account.

No need to give any of wife's account for fund than!!!
