I applied for a 6 month family visitor visa for my husband (he does not want to settle here). I advised the immigration that he was coming for 4 months - supplied all the documents and a copy of the return ticket - they have refused on the grounds that they say the letter he provided from his employers only states he is visiting for 2 weeks so they are not convinced he will return to Jamaica even though his children are there. We have been told to appeal - his works admitted they made an error (I know he should have checked the letter but he didnt and just assumed it was ok) and they will issue a new letter stating that he will get 2 weeks full pay and 14 weeks unpaid leave and that his job will remain open for his return. Can you advise whether it would be better for me to appeal from here and attend an oral hearing? Also should I include any other documents - I can show that I stayed there for 7 months after our wedding and have returned to Jamaica on a further 3 occasions - only reason he is coming here is that i had severe double pneumonia and couldnt visit him as I was off sick for 5 months and only just returned to work and so cannot ask for annual leave yet. Its so annoying coz I had already purchased his ticket not thinking it would be a problem!
