ILR for Tier1 Dependant - outside UK for more than 9mths

hi
I am eligible for applying ILR for myself. I am on Tier1 General visa currently.

My wife stayed with me in the Uk for more than 2 yrs on Tier-1 Dependant visa.
We were expecting baby and she went to India 9 months ago and is now coming back with the baby. Can she apply for ILR (assuming she passes the Life in UK test)? Also can I apply for ILR for the baby (the baby has Tier1 Dependant visa now).
My wife was working in the UK (on Tier1 Dependent visa) and she is still getting maternity pay
Please let me know
1) if I can apply for ILR for my wife and the baby
2) and in case if they reject, will I get any fee refund if I apply for Settlement visa for them.
