Naturalisation Applicable for dependent - confused

Post by bond123 » Fri Sep 21, 2012 11:14 am

Hi folks

I have got my ILR last month and would be eligible for Naturalisation for next year in Aug 2013 based on HSMP and Tier 1 for over 5 years and 1 Year ILR.

Its bit early However, I am bit confused about naturalisation for my wife residency requirement. we got married on Jan 2009 and she came here on Feb 2009, next year she wont qualify for Naturalisation as it will be only 4.5 yrs in Aug 2013. so we willl be applying for Joint Naturalisation application in Feb 2014 to save about £500 approx.

My question is - would she qualify for naturalisation in Feb 2014 based on 5 yrs residency or have to wait longer ?

Any comments, thanks

Thanks sushdmehta for your quick response.

I have read the common question, however the below line confusing me from UKBA website ( link below). since my wife for ILR, she is our of immigration control.

"If you have spent time in the UK while you were exempt from immigration control, you cannot include this time as part of the residential qualifying period. "
