Tier 1G dependant - training post for FY1

Post by hiraimran » Sat Sep 22, 2012 1:54 pm

hello, im a doctor from pakistan on a dependent visa in UK. my husband is tier 1 general and he has a restriction o his paspost that he cannot work as doctor in training but i do not have any such restriction. i have already applied for foundation year 2013 and my application will be accepted if i submit my work visa before 17th january 2013. my visa is expiring in dec and we are applying for an extension.
i want to know if my new visa will have the restriction or will i be able to work in the nhs on a trainee post as i have not done my housejob.
in the teir 1 dependent policy guidelines ive read that :

1. the applicant has obtained bachelors degree in medicine from a UK institution, or
2. has been granted leave to enter / remain and is not subject to any condition restricting their employment, and has been employed during that leave as a Doctor or Dentist in Training,

so according to this i had been given entry clearance without the restriction. can some one please tell me will i be eligible to work or not ?
thanks

When did you apply for your current visa?

I got my current visa in November 2011. Since my husbands visa is expiring in dec 2012 so mine is too

You are lucky that the entry clearance office made a mistake and did not endorse your vignette with the employment restriction. Sadly, doesn't help.

Since you'll not be employed in a training post at the time of your extension application (319D(b)(iii)(2)), any grant of leave will be endorsed with the restriction.

Unless the caseworker makes the same mistake!

But I've also asked one of my husbands friend's wife whose on the same visa as mine and she got hers in may this year. She also doesn't have the restriction although she's not a dr so it doesn't matter to her.

Did you have a Tier 1 (General) dependant visa before then? If Yes, when did you apply for it.

No this is the first time I got tier 1 general visa. However we'll be getting ILR hopefully after 2 years. I mailed ukba about my query but they just asked me to look at pg 7-8 of the tier 1 dependant policy but I checked those pages and it was all irrelevant stuff
About calling them I've tried several times but they never answer

In such case and as per law, your extension will be subject to the employment restriction - unless you have completed your primary medical qualification (MBBS) from UK or you are employed as a doctor in training at the time of your extension application.

I have mentioned the relevant immigration rule (and also provided the link for it) in the response above. The same thing is mentioned in the PBS dependant policy guidance on page no. 7.
