Confused on English Requirements - points then, not now

Post by t1s2010 » Sun Sep 23, 2012 7:39 pm

I got my T1G initial in Nov, 2010.
PBS calculator - English requirements awarded 10 points at that time.

Now, I check PBS calculator and it awards '0' points for same qualification. It does award 35 points for Education.

For first, National Institute of Technology qualification does not award 10 points is a shocker.

Secondly, PBS calculator has another option saying -
I have already proven my English language skills in a previous Tier 1 or HSMP application
So, where do I stand now? Did I prove my qualification or I need to prove again?

Assume, I have to give TOEFL in London, is it easy to get quick dates for TOEFL or it is similar to a PEO appointment?

If you provided the necessary evidence & were awarded the required points for "English Language" during your initial application then there is no requirement to submit evidence again. I.e. you would choose the option "I have already proven my English language skills in a previous Tier 1 or HSMP application" in the PBS calculator.

cs95tdg, not to question your response (I indeed want it this way) but should I take your opinion as a sure shot way or a finger crossed way?

My visa is till 20th Dec but going for early PEO for 17th Oct.
I need immediate Schengen visa for business travel so trying for same day decision.

I am merely stating what the Tier 1 application guidance states.

See point 131 on page 37: http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

If however you find that for some reason the qualification that was used to award you points for "English Language" as part of your initial application is no longer accepted by the UKBA then you can take a look at the following for qualifications that are considered acceptable:

Thanks for guidance point cs95tdg.
Probably, I stand good chance of not having any trouble during extension.
(biased me )

I have put an email to UKBA as well but I don't expect an early reply.
If PEO result does not come out favourable, I will still have 2 months to get it sorted.

Writing my update for any soul (& 4 cs95tdg) having same question in future.

I went for PEO appointment route; and got extension of 3 years without any questions on English requirement.

I didn't bother about UKBA clarification and preferred to take my chance.
I quoted immigration rule on english requirement 11(i) in cover letter to force my point.

I too agree that there are changes in the list of approved educational institutions compared to the list of 2009. Is anyone's extn got rejected since your institution is not in current list ?
