flrm and housing benefit (help please)

hi,

I have applied for flrm in February 2012 and still waiting for final results like many people here, I have a quick question at the moment i am renting 2 bed flat privately and me, my wife(british citizen) and my son (british citizen) now thinking to go on housing benefit as my wife is eligible for it, Can i do that at this stage? It will effect on my application? or it will be helpful for my application as i have no right to work at the moment and my wife is paying the rent so after getting housing benefit as a rent she dont have to pay from her job salary.

i will be thankful if i will get answer to my queries, i know people are so helpful here.

You wife can only apply for housing benefit for herself and the children in the family. The benefits office will have to be notified that you are subject to immigration control and will remain so until you are granted Indefinite Leave to Remain (ILR). FLR won't give you access to Public Funds.
Is your wife claiming Child Benefit (which she's entitled to do) and has she looked into whether she qualifies for Child Tax Credits?

yes she is getting child benefit and child tax credit both, if she will get housing benefit do we need to notify home office about it? it will be a problem changing circumstances? and finally it will be helpful for my flr? because most of the earning of her going to the rent.

As I've already said, you can't be considered in the calculation for Housing Benefit. When applying, your wife will have to make clear to the benefits office that they can only count her and your son when deciding if HB should be paid. Otherwise this would affect your application.

would i be allowed to live in the same house? or are there any restriction for me to live in the house provided by council on my wife and son name?
