FLR (m) for my wife tomorrow

FLR (m) for my wife tomorrow

Hello Sush and other moderators -

I have a query as below -

Me and my wife got married in june 2010, my wife joined me as a TIER 2 PBS Dependent on August 12 2010.

She continued to be on my PBS Tier 2 Dependent till Aug 31 2011, then on September 1 2011 my wife went back to india and changed her visa to TIER 2 General which she is currently on.

I applied for ILR succesfully on 11 Sep 2012 but my wife didnt apply with me because she wasnt on my dependent visa.

My wife is applying for FLR (m) tomorrow 25 september 2012. Me and her have enough financial data which meets all the requirements and more.

Now my question is -->
1) She is applying on FLR (m) visa and not FLR (0), is that the right form?
2) We have got all bills in both of our names that we stayed together for more than 2 years in UK, but she was on TIER 2 General for part of the 2 years while she still continued to stay my wife. Can she fall under the FLR (,m) rules in place before July 9 2012? i.e. can she apply for her ILR immediately after she gets her FLR (m) tomorrow?
3) do i have to also sign in the FLR (m) section where they ask the third party to sign? As i am giving my salary slips as well along with hers for the past 6 months?
4) Will it be ok if my wife fills in the section 7B which as explained in the form is only for spouses who came to UK on the dependent visa prior to July 9 2012, as technically my wife fits the bill as she came on TIER 2 Dependent back in Aug 2010.

As always, i will be thankful for any assistance you guys can provide. and urgently :)

1. FLR(M) is the appropriate form.
2. No, she will be subject to new rules that became effective from 09-Jul-12.
3. AFAIK, you are the sponsor and not a third party.
4. No, she does not fit the bill as she is presently a Tier 2 migrant.

thanks Sush.

so thats a dissappointment.

Can she at least use some of the last 2 years period when she was my dependent, while applying for her ILR 4 years down the line? originally 5 years if no time from last 2 years can be considered.

The earliest she will be eligible for settlement will be 5 years from the date she is granted FLR(M) leave.

Sush, just wanted ot let you know that my wife got her FLR (m) and thanks to your suggestions we did not fill in any additional details that were applicable to pre july 9 2012 dependants.
