Eligibility for ILR?

Post by amitpattjoshi » Tue Sep 25, 2012 8:56 am

Hi,

I have a question regarding my eligibility to PR .

Actually I got my Tier-1 VISA stamped on 4thDec2008 from INDIA. But I entered this country after 35 days from that day ;i.e. on 8th Jan'2009.

Now I have my 1st Tier1 extended after 3 years and of course in 4thDec2013 it will complete 5 years.

But My question is as I delayed by 35 days from the day my first visa got stamped and entered on 8th Jan'2009, Can I apply for PR before 4th Dec'2013 OR I need to do another extension done and apply for PR probably after 8th Jan'2014.

I am not clear if it considers for any number of days like 30-90 days if you did not enter UK and still it takes from 1st day you got stamped and allow for PR??

Anyone has any suggestion of have gone through same kinda situation Please advise ??

Thanks,
Kumar

Thanks very much for the link..

It says 90 days you should not be absent ->

This is the absent period from the day you got entry clearance-> 35 days in my case PLUS when I will apply for PR no of days before expires(e.g. 15 days before expires)

SO total can come to 35+15 = 50 days which is still within 90days absent rule.

So looks Ok in my case what I understood :)..

Thanks Once Again!!
