ILR for my Son

ILR for my Son

I hold Tier - 2 (ICT) Visa at present and I’m due to ILR in this December. My wife and son are in India currently and they will travel to UK in this November before I apply for ILR.

My wife has made her entry to UK on 12/03/2011 and went back to India on 31/03/2012 for maternity. She currently holds Tier 2 Dependent Visa valid upto 14/02/2014.

My son is born in India on 14/07/2012 and he is yet to make his entry into UK. He currently holds Tier2 Dependent visa valid upto 14/02/2014.

Query:

I believe I cannot include my wife while I apply for ILR in December because she has not lived with me in the UK for a min 2 years. But can I include my son while I apply for ILR in December?
