FLR (M) late application - 28days grace?

FLR (M) late application - 28days grace?

My Wife's fiance visa expired on 9th September, there were problems getting married due to the register office not recognizing her nationality which meant we couldn't get a premium appointment before her visa expired. We wrote to our MP to see if he could help get them to make an appointment available but they couldn't. I seem to remember reading on the guidance notes that they would overlook overstays of up to 28 days on FLR(M) applications but the latest guidance notes don't mention this.

Is is worth putting in a FLR (M) postal application out of time or is the only option to leave and reapply for a spouse visa?

FLR(M) application, under old rules, requires valid leave (287(a)).
It appears that FLR(M) application, under new rules, may be possible within 28 days of 09-Sep-12 (E-LTRP.2.2).
