ILR dependent visa - second time

ILR dependent visa - second time

Hi,

My wife has an ILR dependent visa which is expiring in november 2012. her visa was from aug 2010 - nov 2012. she stayed in uk from aug 2010 -dec 2011. we had our second baby so she went back to india and planning to come back in jan 2012. what will be the consideration for her if we apply for a visa from india again? will she be given a ilr dependent visa or directly an ILR as she has a valid reason for going back temporarily.

Do you mean Tier1 visa?

ILR visa does not expire.

It is an ILR dependent visa where it has an expiry and at the end of it you can apply for ILR.

Guess you meant to write Jan 2013.

She will need to apply for entry clearance as spouse of settled person / British citizen and will be subject to the new rules introduced on 09-Jul-12.
