overcrowding statutory definitions

Post by tot » Thu Sep 27, 2012 9:58 am

Hi guys,

I called up my local authority and heard from the customer service that the local authority no longer issues NOC, and that has been since last ten years or so.

Therefore :
1. Alike local authority do agents or landlords have the power to licence temporary overcrowding?

My situation is :

*We are 2 adults and 1 20months baby living in a 1 double bedroom flat consisting 2 rooms.

As per the act we are already 2.5 persons and with an addition of 1 more person we'd be 3.5, which is not permitted as per the act, however the act also mentions that any 2 10yrs+ persons of opposite sexes(if not married) must not be forced to sleep in one room.

Therefore my another question is :

2. So can we accomodate 1 more person in the additional room for the period of temporary visit to us as in our case the additional person can occupy the 2nd room for sleeping and does not share that with anyone. Do I make sense?

Thanks in advance.

cheers

Hi mate,

Well, I actually dwelled to my questions after reading that post. :)
John wrote:"There are no hard and fast rules concerning overcrowding HMOs. Local authorities have the power to serve an overcrowding notice in relation to a house in multiple occupation specifying the maximum number of people permitted in a house, or serve a notice to prevent any further residents. Where an overcrowding notice renders an occupier homeless the council may be obliged to provide accommodation under the Housing Act 1985 - if for example the occupier has dependent children, or is old or infirm. Such accommodation would, of course, count under the Rules as recourse to public funds. In the case of HMOs it may be necessary to obtain written confirmation from the local authority that there is no objection to an additional resident moving in but see paragraph 6.2 above.

NB It should be noted that under the Act local authorities have the power to licence temporary overcrowding.
"
So if you read my query now I was wondering if anyone has had similar situation and requested the owner/agent to underwrite a letter which may considerably allow temporary overcrowding. As I dont really intend to move to a 2 bed property just for 5 weeks.

Do I make sense?

Thanks again,
tot
