do we need to wait 2 years to apply for ILR?

Hi, I am a UK citizen and am married to an Indian citizen, we currently live in India with our 2 children but will shortly be moving to the UK. He has recently been granted leave to enter under the old rules, we just managed to get his application in before July 9th. We were hoping initially that he could apply directly for ILR as we have been living together outside of the UK for more than 4 years. Unfortunately though he didn't have time to take the knowledge of life in the UK test before we had to return to India to make his application but we were told that hopefully he should get a code at the bottom of his visa saying KOL required, indicating that he need only take the test and can then apply straight away for ILR rather than having to wait for the 2 years.

We're so pleased that he got his visa but unfortunately it doesn't have this code on it....so my question is can he take the KOL test and apply immediately for ILR or does he now have to wait for 2 years? It's difficult to find much information now on the UKBA website as all the info now seems to be for the new rules which came into affect on July 9th.

What is the endorsement on his visa vignette? Please check and share.

I'm sorry I don't know what you mean by 'endorsement in visa vignette'. Apologies for not replying sooner, I was expecting an email when I received a reply to my query so hadn't chcecked back on this site since my posting

What is written (on the visa stamp) against:

Type of visa
Remarks

It says:

Type: Visa spouse/CP
