Hello to you all
I need your professional advised ON APPLYING For CITYZENSHIP. it's so frustrated as i'm ready to go until I spoke to NCS today that she said I might not eligible. I thought it straightforward as i'm living here more than 7 years it should cover everything.
I first arrive in the uk on 17 NOV 2004 wtih visa EEA family permit which valid from26/10/2004 to 26/10/2006 (2 years) then I applyied for residence card of a family member of an EEA valid from 03/04/2007 to 03/04/2012 (5 years)
then I called the HO office said I don't have to apply for permanent resident because on the website stat that the Eea family permit person live in UK 5 years will automatically have permanent residence so I din't apply for confirmation of permanent resident certificate.
QUOTE from website:If you are a national of a country in the European Economic Area (EEA) or Switzerland, or you are the family member of such a person, you will automatically have permanent residence status if you have exercised EEA free-movement rights in the UK for a continuous five-year period ending on or after 30 April 2006. You do not need to apply for leave to remain. You should have held permanent residence status for 12 months before you apply for naturalisation.
now I'm talking to NCS she siad I need to have permanent resident or IRL status when I told I don't have it in paper to confirm but as the rule Ihave permanent status. as it said above she siad she not sure about it. now i'm stuck pls give me advised what should I do? Do I eligible for applying AN or I have to applying for the confirmation of permanent residence card first which could take a long time in all.
Another question is there is gab between my first visa and residence card that took 6 months to approve from HO that class as absent for my qualify perioud?
I hope you to hear from you thanks

Residence documents under EEA regulations are optional and you don't need to have PR Confirmation to apply for naturalisation. Also there is no problem with gaps as applying for the documents is option.
Before spending £850 on the application, I suggest you verify that have obtained PR status (at least 1 year ago). This would depend on the activities of the EEA national and not yours. How did the EEA national exercise treaty rights? Was the EEA national working? studying?

Hi Jumbo
Thanks for your reply, I thought the same originally untill I spoke to NCS she said never had any instruction from HO about EEA is optional to get PR confirmation.
as your question My EEA national exercise treaty right. He had always working and I got P60 to support on that matter. come to this subject the lady from NCS said I apply AN base on my residency is nothing to do with my EEA national that even more confusing. She didn't ask for my EEA national support document. What do you suggest???

Try another NCS (you can use any one you wish and you can specify where you wish the ceremony to be held) or call again and try to speak to someone else or call again and ask her to call the HO. The AN form has a specific section for EEA nationals.

Funny enough I have been trying to call both HO and NCS but can't get through to person just got voice message refer to check HO website. I send HO email it said will take up to 10 working days for reply, finger cross they not so busy and reply back to me quickly.
Thanks for all your advised I'm very appreciated.
